Terms of Service
1. Introduction
These Terms of Service govern the legal relationship between the operator of the service and its visitor or user.
2. Nature of the service
The service is intended to support orientation within the model, interpretive and market layers of apartment building management, operation and related services. The service may include:
- curatorially prepared model structures,
- records of providers and service offers,
- verification and other trust-related indicators,
- user contributions, change proposals, comments and related content.
The operator strives for accuracy, clarity and usability, but does not guarantee the completeness, error-free nature, currentness or universal suitability of all information for every particular case.
3. No automatic recommendation or guarantee
The display of a provider, service offer, verification status, reputation signal or any other trust indicator does not by itself constitute:
- a recommendation to enter into a contract,
- a guarantee of professional quality,
- a guarantee of legal correctness,
- a guarantee of economic suitability,
- a guarantee of suitability for a specific situation.
Users remain responsible for independently assessing the suitability of a service and verifying relevant facts outside the portal where the nature of the intended decision requires it.
4. Verification and trust indicators
Verification is a specific layer of the service. Its purpose is to transparently record that certain claims about a provider or offer have been checked according to the rules of the operator or another expressly identified subject.
Verification does not mean an absolute guarantee of quality, accuracy, legality or future performance. Its scope and significance must always be assessed with regard to the specific level, date, source and verification methodology.
The operator may publish the rules of verification in a separate policy or supplement them with special terms.
5. User accounts and contributions
If the service allows registration or the submission of change proposals, comments, provider records, offers or other content, the user is responsible for ensuring that:
- the submitted content is truthful to the extent presented as truthful,
- the user has the right to submit and make the content available,
- the content does not infringe third-party rights or violate applicable law,
- the content is not misleading, fraudulent, abusive or otherwise improper.
By submitting content, the user grants the operator the license described in the License Terms or in these Terms of Service.
6. Moderation and operator actions
The operator may:
- moderate,
- classify,
- hide,
- temporarily disable,
- merge,
- archive,
- modify to the extent necessary for technical or editorial processing,
- remove content,
especially where necessary to protect third-party rights, database integrity, service trustworthiness, compliance with legal obligations or prevention of abuse.
7. Prohibited use
Without prior written consent of the operator, users may not in particular:
a) systematically extract, bulk download or re-utilize substantial parts of the database content;
b) use automated means for ongoing collection, copying or synchronization of content in order to create a substitute or competing database;
c) circumvent technical, organizational or contractual restrictions on access to the service;
d) submit content that the user knows or should know is false, misleading, unlawful or infringing third-party rights;
e) misuse verification, reputation or other trust indicators in a way that could create a false impression regarding the position of the provider, offer or operator.
Nothing in this section limits rights granted by mandatory law.
8. Availability of the service
The operator does not guarantee uninterrupted availability of the service. The operator may modify, limit, suspend or terminate the service, its parts or particular functions where reasonably necessary.
9. Liability
The operator is liable to the extent required by applicable law. Unless the law provides otherwise, the operator is not liable for indirect damage, loss of profit, loss of business opportunity or decisions made by users solely on the basis of portal information without further verification.
10. Privacy
Processing of personal data is governed by the separate Privacy Policy. The use of cookies and similar technologies is governed by the separate Cookies and Analytics notice.
11. Changes to the terms
The operator may reasonably amend these Terms of Service. The new wording becomes effective on the date of publication unless stated otherwise.
